This is an action on the case brought by the plaintiff Nick Mihas, for personal injuries sustained on or about March 16, 1926, on the premises of the defendant company, in the city of Peru and State of Indiana. The suit was brought under the Federal Employers’ Liability Act, the plaintiff having been an employee of the defendant at the time of the accident and for a number of years prior thereto, and resulted in a verdict in favor of the plaintiff and against the defendant in the sum of $20,000, and upon this verdict judgment was entered by the trial court and it is from this judgment that…
