COOPER, District Judge.

The sole question for decision here is whether the plaintiff, a resident of Pennsyl vania, bringing an action in this Court on the ground of diversity of citizenship, for negligence arising in this district of New York, is civilly dead and cannot maintain his action because of the fact that prior to the negligence he was convicted of murder in the first degree in the State of Florida and sentenced to life imprisonment in that state.
