In a proceeding pursuant to Real Property Tax Law article 7, the petitioner appeals from an order of the Supreme Court, Dutchess County (Palella, J.), dated April 19, 1995, which, upon denying the branch of its motion which was for summary judgment dismissing the first affirmative defense of the Board of Assessment Review, Town of La-Grange, dismissed the proceeding on the ground that the *401petitioner’s default in failing to appear at a hearing constituted "willful neglect”.

Ordered that the order is affirmed, with costs.
