The defendant, Robert Max Campbell, entered a plea of guilty in the circuit court of Rock Island County to an indictment charging him with the crime of burglary and was sentenced to the penitentiary for a term of not less than 3 nor more than 10 years. His post-conviction petition under article 122 of the Code of Criminal Procedure of 1963 (Ill. Rev. Stat. 1967, chap. 38, par. 122—1 et seq.) was denied on the State’s motion without an evidentiary hearing, and the defendant has appealed from the order denying the petition.
