MEMORANDUM

NEALON, District Judge.

Defendant was indicted on January 25, 1976 by a federal grand jury for theft of government property in violation of 18 U.S.C. § 641. The item which defendant is alleged to have stolen is a color television set that had been purchased with funds furnished under Title I of the Elementary and Secondary Education Act of 1965, 20 U.S.C. § 241a et seq. (Title I), and, at the time of the alleged theft, was in the possession of the Wilkes-Barre School District, which was using it in a Headstart program.
