J. D. Perry was indicted and tried in the Superior Court of McDuffie County for the murder of Emmett Dunn Jr., and was found guilty of involuntary manslaughter in the commission of an unlawful act without intent to kill. He filed a motion for a new trial and an amendment thereto containing three special assignments of error, and after a hearing the motion was overruled. To this judgment he excepts.
