This matter is before the Court on defendant David Wittig’s Motion for Order for Payment of Fees or, in the Alternative, Stay of Criminal Proceedings (Doc. 838). Defendant Wittig requests this Court to exercise its ancillary jurisdiction and order Westar Energy, Inc. (‘Westar’!) to honor its advancement obligation to him on a prospective basis for. the upcoming third trial.
