Plaintiffs C. Steven Fury, William E. Fitzharris, Kevin McKinney, Ron Lindsay, William Wasserman, and Marsha Pechman brought suit for declaratory and injunctive relief against the City of Seattle. The plaintiffs prevailed on summary judgment. The issues before this court are the validity of the City's DWI 1 checkpoint program under the fourth amendment of the United States Constitution and under article 1, section 7 of the Washington State Constitution.
