CUMMINGS, Circuit Judge.

Robert Sween appeals from a jury award of $60,000 in compensatory and punitive damages to Lynne Ammerman for assault and battery as defined under Wisconsin tort law. The sole issue on appeal is whether the district court had subject matter jurisdiction over this state law claim. We affirm.

Ammerman worked as a micro lab instructor at North Central Technical College in Wausau, Wisconsin. In January 1994, she filed a complaint against her employer and Sween, another instructor at the college, raising several claims arising from Sween’s alleged sexual assault of Ammerman…
