Appeal (taken prior to January 1, 1972) from dismissal of plaintiffs action for $111,948.88, damages to property.

Plaintiff alleged: that defendant Kansas City was a municipal corporation, organized according to law, with a population since 1870 in excess of 30,000 persons; that plaintiff was a corporation engaged in insuring property of others against loss caused by fire, riot, civil commotion, and other perils; that by contract or policy of insurance, plaintiff insured the property of Parkview-Gem, Inc., used in its retail businesses at 2818 East 27th Street and 3207…
