Hart, C. J.,
(after stating the facts). The circuit court erred in not directing a verdict for the defendant as requested by it.. In a case-note to L. R. A., at page 1060, it is said in the case of joint tort-feasors the essential unity of the injury and the fact that the injured party is entitled to but one compensation therefor make it impossible for the injured person to settle wi,th one tort-feasor without discharging the other.
