In May of 1993, Schwartz, Gutstein and Associates, a law firm representing the estate of Marcial Valentin, Sr. (Estate) in a wrongful death action, forged the indorsement of Marcial Valentin, Jr., the administrator of that Estate, on a check made jointly payable to the Estate and the law firm. The check represented the proceeds of a settlement of that action with Progressive Insurance Company.
