This action was commenced for the purpose of declaring null and void two annuity agreements, dated April - 8, 1904, and October 6, 1904, respectively, which were made and entered into between the defendant and one Robert T. Hicks, now deceased.

The plaintiffs are the residuary legatees under the will of said Robert T. Hicks, deceased. Anthony D. Schroeder *393and the defendant, Waterman, were the executors of said will. Mr. Schroeder, as such executor, was originally joined as one of the plaintiffs herein, but he died after the suit was commenced and, by an amendment made upon the trial, his name…
