The appellee, while working for appellant, on the 10th day of February, 1916, was injured by an accident. The appellant inaugurated what is designated “Plan for Employees’ Pensions, Disability Benefits and Insurance. ’ ’ The plan, among other things, provided :

(1) All employees of the company on January 1, 1913,'and thereafter shall be qualified to receive payments under the regulations on account of physical inabilities to work by reason of accidental injury during employment while in the performance of work for the company.
