The facts which gave rise to this suit may be briefly stated as follows: On the thirteenth day of May, 1886, the Dallas & Greenville Railway Company entered into a contract with J. F. O’Connor & Company, its coappellants, for the construction of its line of railroad between the two cities designated by its corporate name. The contract bound O’Connor & Company to complete the road under the supervision of the chief engineer of the railway company for certain considerations therein expressed.
