Durango Georgia Paper Company (“Du-rango”) consented to an involuntary petition for relief under Chapter 7 of the Bankruptcy Code on October 29, 2002, and converted its case to Chapter 11 on November 19, 2002. On February 23, 2004, James Cunningham (“Cunningham”) as Trustee for the Chapter 7 Bankruptcy Estate of United Paper, Inc.
