MEMORANDUM OPINION AND ORDER

Lee Boyd Malvo (“Petitioner”) has submitted two motions pursuant to Title 28, United States Code, -Section 2254 for writs of habeas corpus by a person in state custody (“§ 2254 motions”). Chief Warden Randall Mathena (“Respondent”) filed a motion to dismiss Petitioner’s § 2254 motions. Having thoroughly reviewed the Parties’ filings in this case, the Court finds this matter is ripe for judicial determination.
