WILSON, Circuit Judge.

This is an appeal from a decree of the District Court of Massachusetts adjudicating the appellant a bankrupt on June 24, 1981. The petition in bankruptcy was filed by the appellee as a single creditor, and sets forth that there were less than twelve creditors.

The petition alleges that the petitioner was a creditor to the amount of $7,028.78, and that within four months of the filing of the petition the alleged bankrupt conveyed to one Muollo two parcels of real estate; that each conveyance was without consideration and was made by the alleged bankrupt with the fraudulent…
