Two questions are presented for our consideration, to both of which the attention of the judge who tried the cause, and the attention of the counsel, was distinctly called at the time of the trial. First; whether the right to stop in transitu still existed at the time the agent of the plaintiffs applied to Heyer, the importer, and requested him to give up *630the goods to them, on account of his failure 1 Second ; whether such a demand from the vendee was a proper exercise of the right to stop in transitu; and to enable the plaintiffs to maintain this action against the vendee, for…
