OPINION AND ORDER

LATCHUM, Chief Judge.

Plaintiffs’ motion presently before the Court seeks an order pursuant to Rule 23(c)(1), F.R.Civ.P., to maintain this case as a class action.

This private antitrust suit charges the defendant with violations of Section 1 of the Sherman Act, 15 U.S.C. § 1, and Section 3 of the Clayton Act, 15 U.S.C. § 14. Jurisdiction is based on Sections 4 and 16 of the Clayton Act, 15 U.S.C. §§ 15 and 26. The plaintiffs seek to recover treble damages, suit costs, including reasonable attorney fees, and to obtain injunctive relief for alleged injuries to the business and…
