Following a discussion of the issue at the initial pretrial conference held on January 3, 2008, the government filed a motion in limine to preclude POGO and Berman from introducing any evidence of their “subjective intent” at trial. Familiarity with the facts set out in United States v. Project on Gov’t Oversight, 525 F.Supp.2d 161 (D.D.C.2007) (“POGO III”), is now assumed.
