The plaintiff brought this action against Leander S. Murphy and Fremont Ice & Fuel Company to recover *542damages for injuries sustained in a collision between the truck on which plaintiff was riding and a Chevrolet coupé driven by the defendant Murphy and owned by the Fremont Ice & Fuel Company. The City of Fremont was made a defendant under the provisions of the Workmen’s Compensation Act.
