Judgment, *124Supreme Court, New York County (Howard Bell, J.), rendered March 19, 1993, convicting defendant, after a jury trial, of assault in the first degree and criminal possession of a weapon in the second and third degrees, and sentencing him, as a second felony offender, to concurrent terms of 6 to 12 years, 6 to 12 years, and 3 to 6 years, respectively, unanimously affirmed.

Defendant made no showing that it was necessary for the court to appoint an expert (County Law § 722-c) to testify about the purported availability of scientific tests which were not performed in this case. In any…
