**106 Jack Eugene Turner appeals the decision of the Court of Appeals of Virginia upholding his conviction for displaying a noose on a public place with the intent to intimidate, and placing others in reasonable fear of death or personal injury, in violation of Code § 18.2-423.2. Turner argues the display was not proscribed under the statute because, although visible from a public road, it was located on his own property. Concluding that the noose display was on a public place under our construction of the statute, we affirm the conviction.
