Reversing.
N. W. Smith and wife, Elizabeth Smith, Polly Ann Boggs, Joseph Combs, and- other, brought this action of trespass against the Kentucky Coal Lands Company and Gr. B. Branson, to try title to a tract of land described in the petition, and located in Perry County, Kentucky. The petition charged that the defendants had cut and removed from the land timber of the value of $1,500, and that plaintiffs were the owners of the timber and the land from which it was cut. Gr. B.
