The plaintiff is the owner of lands adjoining the new Granville-Hartford State highway. The defendant built the road. The complaint alleges that the defendant trespassed upon *243plaintiff’s lands, opened a stone quarry thereon and wrongfully operated the quarry and took therefrom and converted a large quantity of rock. By stipulation in writing the defendant admits the trespass and conversion. The issue tried and submitted is the amount of damages.
