In this voluntary Chapter 7 proceeding filed on March 12, 1981, by debtors Albert Richard Berndt and Parie Rosezella Berndt, the trustee filed an Application for Turnover seeking a court order requiring debtors to turn over to the trustee both documentation of and present benefits in an employee savings and profit sharing program. The debtors opposed turnover by asserting that the funds are not property of the estate as defined by section 541 of the Bankruptcy Code.
