The peculiar state of case, upon which the question here to be determined arises, is as follows : Upon the remanding of this cause, after the decision of it by this court, reported in 3 Eng. 345, various amended pleas were interposed by the several defendants, to which the plaintiffs replied, and upon which issues of fact were formed, properly triable by a jury.
