As originally instituted this is an action in trespass to try title by J. H. Yotaw, F. G. Morris, Y. A. Collins and the Beaumont Improvement Company, against W. E. Holland, Lewis Johnson, Eli Bendy, Kinzie Johnson and Mrs. Eugene Bail, a femme sole, for the title and possession of a tract of land, a part of the James Drake survey, described in the petition, of which Yotaw and Collins are alleged to own an undivided one-fourth, the Beaumont Improvement Company an undivided one-fourth, and F. 6. Morris an undivided one-half interest.
