THOMAS, District Judge.
The ferryboat Albany, on the 9th day of March, 1896, at about 8 o’clock- a. m., left her slip at Weehawken, N. J., on the west side of the North river, bound for Franklin street, New York, on the opposite side, distant about 5 miles from the place of starting. The river, is about 2,800 feet in width between such termini. Fog had interrupted navigation for several hours, but had cleared sufficiently to justify navigation.
