There is practically no question as to the facts in this case. They are these: On June 6, 1891, the respondent, the Citizens’ Bank of Fairhaven, recovered a judgment against J. B. Brisbois, in the superior court of Whatcom county, for the sum of $1,818.75, together with costs and attorney’s fees. Some time during the same year the said Brisbois instituted an action against the Bellingham Bay Boom Company to recover the amount alleged to be due and owing to him on account of money advanced and labor performed for and at the instance of the…
