In an action to recover damages for personal injuries, etc., the third-party defendant appeals from an order of the Supreme Court, Suffolk County (Corso, J.), dated April 10, 1984, which denied its motion for summary judgment dismissing the third-party complaint.

Justice Thompson has been substituted for the late Justice Gibbons (see, 22 NYCRR 670.2 [c]).

Order modified, on the law, by deleting the provision thereof which denied that branch of the third-party defendant’s motion for summary judgment which was to dismiss the cause of action which alleges a violation of Labor Law § 240, and…
