1,1 disagree with the majority’s finding that petitioners met their burden of proving the consent of K.M.B. was not needed for the adoption. Accordingly, I find the trial court erred in failing to appoint an attorney to represent B.E.S. See, In re T.M.L., 06-1142 (La.App. 1 Cir. 12/28/06), 951 So.2d 364. Therefore, I would vacate the trial court judgment and remand for rehearing after appointment of counsel for B.E.S.
