This controversy involves the title and ownership of a *439house and lot in Covington, Ky., which was owned by William Noonan prior to his death, in 1871. His wife, Ann Noonan, and three sons, John, William, and Charles Noonan, and one daughter, Lizzie Klenke, survived their father. The appellee, Mary Ellen Noonan, and Thomas Dunn, as next friend of her infant children, Helen and John Noonan, Jr., brought this action in the Kenton circuit court on the 30th of December, 1897, in which they allege that the appellee Mary E.
