Williams, J.:

The order appealed from should be reversed, with ten dollars-costs and disbursements, and the motion granted, with ten dollars costs.

The action was brought against Windholz, residing and doing business in Syracuse, and Crouse & Sons, residing and doing business in Utica, to recover penalties for alleged violations of sections. 50-53 of the Agricultural Law (Laws of 1893, chap. 338, as amd., by Laws of 1901, chap. 308), relating to the illegal sale of adulterated vinegar.
