In an Opinion & Order issued on April 23, 2014, 18 F.Supp.3d 430, 2014 WL 1642970, the Court dismissed the federal claims in the Amended Complaint filed by plaintiff Ergowerx International, LLC, doing business as Smartfish Technologies, LLC (“Smartfish”).
