OPINION

BRUGGINK, Judge.

The State of Alaska alleges that the United States is liable for breach of contract damages for not living up to certain terms of the Alaska Statehood Act, or in the alternative, that it has taken the State’s property without just compensation in violation of the Fifth Amendment to the United States Constitution. Pending is Alaska’s motion for partial summary judgment and defendant’s cross-motion for summary judgment. The State’s motion only addresses count V of its complaint.
