Oliver Wright Motors, Inc., is a business located within the police jurisdiction of the City of Albertville, but outside the city limits. In January 1992, Oliver Wright filed a class-action complaint challenging the constitutionality of § 11-51-206, Ala. Code 1975, which authorizes a municipality to levy a sales tax on consumers who make purchases from businesses located outside the municipality's corporate limits but within its police jurisdiction.1 Oliver Wright sought to represent other businesses similarly located ("the Businesses").
