Cross-appeals from a judgment of the superior court for Pierce county, Huston, J., entered March 19,1906, upon findings in favor of the plaintiff, after a trial on the merits before the court without a jury, in an action to recover the amount due from the sale of land.

On the 20th day of January, 1906, the defendant Cady, acting for himself and the plaintiff Lazier, purchased an option on eight acres of tide land, in Pierce *340county, for the sum of $100. The option contract provided that the holder of the option might purchase the land within thirty days at $2,500 per acre, or $20,000 in all, the terms of payment to be $4,900 cash at the expiration of the option, and the balance in three equal installments of $5,000 each, payable in six months, one year and two years respectively.
