Defendant Adan Garcia-Figueroa appeals his sentence after conviction for conspiracy to bring illegal aliens into the United States, bringing illegal aliens into the United States, and being unlawfully present in the United States following a prior deportation. Specifically, he challenges the district court’s application of the United States Sentencing Guidelines (“U.S.S.G.”), averring that the district court erred in its assessment of a 12-level crime of violence enhancement, and in its grouping of Garcia-Figueroa’s counts of conviction.
