The Plaintiff in Error was convicted in the Criminal Court of Record of Dade County, Florida, of the crime of obtaining money by false pretenses. The information was in two counts but there was an election by the State to stand upon the first count of the information. The first count of the information is in the following language, to-wit:

“IN THE NAME AND BY AUTHORITY OF. THE STATE OF FLORIDA:

G. E. McCaskill, County Solicitor for the County of Dade, prosecuting for the State of Florida, in the said County, under oath, information makes that Caroline Antrobus of the County…
