The first count of the plaintiffs’ declaration is in trespass for the taking and converting to his own use by the defendant of large quantities of sea-weed alleged to be the proper goods and estate of the plaintiffs. This seaweed was cast upon the shore adjoining the defendant’s land, and was there, below higli-water mark, taken by the defendant and converted to 1ns own use.
