Appeal by plaintiff from an order of tbe district court for Bamsey county, Simons, J., presiding, sustaining a demurrer to tbe complaint.

Action upon a penal bond executed to tbe plaintiff by tbe defendant Doyle as principal, and by tbe other defendants as sureties. Tbe defendants demur to tbe complaint. Tbe complaint shows that Doyle entered into a contract with tbe plaintiff, in May, 1883, to construct a stable upon land of tbe latter, and to furnish tbe labor and material therefor, and that this bond was made to secure the plaintiff from liens upon tbe premises for labor done or materials furnished to Doyle in tbe performance of bis contract.
