Horatio Hartley died on the 27th day of August, 1912, leaving a last will and testament, which was duly admitted to probate in Winnebago county, on the 14th day of September, 1912. At the time of his death, he was the owner of the property involved in this suit. He left surviving him Alice Hartley, his widow and Leta Hartley Hiestand, Elvin Hartley and Ray Hartley, his children, as heirs at law.
