In North v. Hawkinson, Mo., 324 S.W.2d 733, 743, the question presented was whether the nonclaim provisions of the new probate code “were intended to apply to an action in equity filed in the circuit court against the executor of a probate estate-more than nine months after the first publication of letters testamentary.” We held that the action filed out of time was barred *680because the nonclaim provisions had the legal effect of statutes of limitations and superseded the general statute which would have otherwise been applicable in that case.
