ALTENBERND, Acting Chief Judge.
Emmanuel Kavallierakis appeals his judgments and sentences for possession of methylenedioxymethamphetamine (MDMA) and habitually driving with a revoked license, two third-degree felonies. Following the denial of his motion to suppress, Mr. Kavallierakis pleaded nolo con-tendere and reserved his right to appeal the dispositive suppression issue. Based on the supreme court’s decision in Thomas v. State, 761 So.2d 1010 (Fla.1999), we reverse the judgment for possession of MDMA.
