— Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany County) to review a determination of the Commissioner of Public Safety of the City of Albany, dismissing petitioner from his position as a member of the Police Department of the City of Albany. On this proceeding, petitioner contends that the determination of the Commissioner was arbitrary, capricious and not supported by substantial evidence.
