Appeal by the defendant from a judgment of the Supreme Court, Queens County (Savarese, J.), rendered April 3, 1990, convicting him of criminal sale of a *824controlled substance in the third degree, criminal facilitation in the fourth degree, and resisting arrest, upon a jury verdict, and imposing sentence.

Ordered that the judgment is modified, as a matter of discretion in the interest of justice, by reversing the conviction for criminal facilitation in the fourth degree, vacating the sentence imposed thereon and dismissing that count of the indictment; as so modified, the judgment is affirmed.
