The Levay Court further explained that the theory of injury did "not concern the price of the insurance policy per se ," but was that "consumers were 'duped' into joining AARP and paying membership fees in order to access the AARP-branded polices from UnitedHealth," without being told that AARP made "a commission on each sale" and had this ulterior motive to recommend the policies.
