DICE, Judge.

The offense is driving while intoxicated; the punishment, three days in jail and a fine of $50.

The evidence was undisputed that on the night in question, the appellant, while operating his 1960 Ford pick-up upon a public highway, drove off the road and struck a tree. The accident occurred around 8:30 P.M., on what was referred to in the testimony as the Arnett-Canadian Highway. At the time of the collision, Jackson Wolfe, a sixteen-year-old boy, was riding with appellant and both parties were taken from the scene to the Hemphill County Hospital at Canadian.
